Welcome to NiteOut. These Terms of Service ("Terms") govern your access to and use of the NiteOut mobile application and website (the "Service"). By creating an account or using the Service, you agree to these Terms.

Eligibility

You must be of legal age to enter venues that serve alcohol in your jurisdiction and able to form a binding contract to use NiteOut. NiteOut does not serve, sell, or supply alcohol, and is not responsible for the venues, events, or third parties surfaced in the app.

Your account

You're responsible for the activity on your account and for keeping your credentials secure. Provide accurate information and let us know promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

User content

You retain ownership of the content you create — stories, photos, posts, RSVPs, and messages ("User Content"). By sharing User Content, you grant NiteOut a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it as needed to operate and improve the Service.

You agree not to post User Content that:

  • Is unlawful, harassing, hateful, threatening, or abusive;
  • Infringes anyone's intellectual property or privacy rights;
  • Is sexually explicit, promotes violence, or endangers others;
  • Impersonates any person or misrepresents your affiliation;
  • Contains spam, malware, or attempts to disrupt the Service.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Access, scrape, or collect data from the Service without permission;
  • Interfere with the security or integrity of the Service;
  • Reverse engineer or attempt to extract source code, except as permitted by law.

Safety and personal responsibility

NiteOut helps you discover nightlife, but your safety and choices are your own. Drink responsibly, follow all applicable laws, and use good judgment when meeting people or attending venues and events. NiteOut is not responsible for the conduct of any user, venue, or third party.

Third-party services and content

The Service may include content or links from third parties (for example, venue information or GIFs). We don't control and aren't responsible for third-party content, products, or services.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service and its users.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, NiteOut will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service.

Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here and revise the "Last updated" date above. Continued use of the Service after changes take effect means you accept the updated Terms.
